The Sweepstakes is open to anyone in the Sweepstakes location during the entry period, who are twenty-one (21) years of age or older at the time of entry. Proof of age may be required. Employees, officers, directors and representatives of Sponsor and each of its respective parent companies, subsidiaries, affiliates, divisions, their respective advertising and promotion agencies and members of the immediate family of each of the above are ineligible to enter or win a prize. The term “immediate family members” includes spouses, parents, step-parents, legal guardians, children, step-children, siblings and step-siblings, grandparents and grandchildren and each of their respective spouses and any other person residing in the same household, whether or not related. Void outside of the fifty (50) United States, and the District of Columbia, and where prohibited by law. All federal, state, and local laws apply.

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN, NOR WILL A PURCHASE OR PAYMENT INCREASE ODDS OF WINNING.

The Sweepstakes entry period is 12:00PM to 5:00PM, Eastern Time (“EST”) on October 6, 2019 (“Sweepstakes Period”). The Sponsor’s clock is the official time for the Sweepstakes.

To be entered for a chance to win, visit the CheapOair Booth located at the South Street Seaport (the “Site”) during the Sweepstakes Period and complete the Official Entry Form.

Limit one entry per person. Entries that (i) exceed the limit stated above, (ii) are late, illegible, incomplete, damaged, delayed, lost, tampered with, incomprehensible, forged, mutilated, misdirected or inaccurate, (iii) generated by a script, macro or other automated/repetitive electronic means or (iv) otherwise not in compliance with these official rules will be disqualified. All requested information on the entry form must be completed in English to enter and be eligible.

Sponsor is not responsible for lost, illegible, incomplete, mutilated or stolen entries; errors appearing on the entry form, within these Official Rules, in any Sweepstakes related advertisements or other materials; or other errors of any kind whether mechanical, human, electronic or otherwise.

Odds of winning the Sweepstakes depend solely on the total number of valid entries received during the Sweepstakes Period.

Winner will be selected by Sponsor in a random drawing from all eligible entries received during the Sweepstakes Period, on October 6, 2019. Sponsor reserves the right, at its sole discretion, to choose an alternative winner (also by a random drawing from among the remaining eligible entries) in the event that the original winner (or subsequently chosen winner) is disqualified, declines the prize or is deemed ineligible. All decisions made by Sponsor regarding this Sweepstakes are final.

Winner will be notified by e-mail and/or telephone promptly following drawing. Winner will be sent (via facsimile and/or other method determined in the sole discretion of Sponsor) an affidavit of eligibility together with liability/publicity release (“Affidavit and Release”). Winner must complete and return (as directed by Sponsor) the Affidavit and Release (unless restricted by law), which must be received by Sponsor no later than seven business days after the Affidavit and Release is sent to winner. Additionally, all guests of winner must complete, sign and return a Travel Companion Liability Release, and where permitted by law, a Publicity Release prior to issuance of travel documents. If any guest is a minor, minor must have a parent or legal guardian sign the documents on the minor’s behalf and the minor must be accompanied by such parent or legal guardian. Before a winner is entitled to receive a prize, such winner is required to provide Sponsor with a valid, properly completed and executed IRS Form W-9 (in addition to any other requested information) for tax purposes as well as a valid government issued photo identification card and, within seven business days of being notified of selection, a recent photo of themselves within 10 days of notification of winning.

Sponsor shall have no liability for any winner notification that is lost, intercepted or not received by the potential winner for any reason and Sponsor not obligated to leave voice mail, answering machine or other message. Proof of response by a potential winner does not constitute proof of receipt by Sponsor.

Eligible winner(s) will receive:

Two (2) round trip economy class tickets from any Qatar Airways gateway in the US (JFK, Washington, Boston, Miami, Atlanta, Chicago, Houston, Dallas Fort Worth, Los Angeles, or Philadelphia) to India, Nepal, Sri Lanka, Pakistan, Bangladesh, Malaysia, Indonesia, Singapore, Thailand or Hong Kong only.

Winner(s) will be financially responsible for getting to one (1) of these US gateways.

Cost per ticket not to exceed US ONE THOUSAND FIVE HUNDRED ($1500) (roundtrip) taxes inclusive.

The total approximate retail value (“ARV”) of the prize is US THREE THOUSAND DOLLARS ($3,000). Actual value of the prize may vary based on airfare fluctuations and distance between departure location and destination. All applicable federal, state, and local tax laws apply. The Internal Revenue Service (“IRS”) requires Form 1099-MISC to be issued and filed with the IRS for each recipient of a prize who is a resident of the United States if the value of that prize is at least SIX HUNDRED DOLLARS ($600). Reporting and payment of any applicable federal, state, and local taxes is the sole responsibility of prize winner.

All travel plans for winner and any guest(s) must be booked and issued at one time through CheapOair.com, by March 31st, 2019. Travel must be completed within four (4) months from first outbound date. The dates valid for travel originating from New York to destination must be from October 7, 2019 to December 9, 2019 and January 7, 2020 to June 10, 2020 only. Black out period is December 10, 2019 to January 6, 2020. All travel requests will be fulfilled based on availability. Guest of winner must be twenty-one (21) years of age or older. If winner is unable to travel by date indicated, prize will be forfeited. Prizes may not be transferred or assigned except by Sponsor. Winner must meet the designated car rental company’s requirements in order to receive the car rental portion of the prize, if any.

If prize includes international travel, customs and immigration require certain documents to travel to foreign country; it is the winner’s sole responsibility for winner and any guest to travel with the required documents. No refunds will be made if improper documentation or failure to comply with any of the rules and regulations of the travel provider results in denied boarding or entry, and prize will be forfeited. Unless otherwise designated, all air travel will be provided by an airline designated by CheapOair.com. Prizes, reservations, and airline (or cruise) tickets are non-refundable, non-transferable, non-changeable once issued, and may not be used in conjunction with any other competition or offer. No refunds or credit changes are allowed. If tickets are lost, stolen or expire prior to use (unless restricted by law), they will not be replaced. Credit for previous purchases is not permitted. All tickets are subject to the vagaries of flight variation, work stoppages, and schedule or route changes.

The prize will only be awarded to eligible winners if the prize if properly claimed in accordance with these official rules. All other costs and expenses related to prize acceptance and use not specified in the official rules are the sole responsibility of winner(s). Winners are not entitled to exchange, transfer or assign prizes or to obtain cash or other substitutes, but Sponsor, in its sole discretion, may substitute a prize of equal or greater value. By participating in this Sweepstakes, each entrant agrees to be bound by these official rules and the decisions of the Sponsor, which are final and binding in all respects and cannot be appealed. By entering, each entrant agrees and acknowledges that Sponsor and its parent company, affiliates, divisions, subsidiaries and advertising and promotions agencies, and each of their respective employees, officers, shareholders, representatives, directors and agents (collectively, “Releasees”) are not responsible for and shall not be liable for: (i) late, lost, delayed, misdirected, mutilated, incomplete, inaccurate, garbled or unintelligible entries; (ii) telephone system, facsimile, technical or computer malfunctions, lost connections, disconnections or transmission or other errors of any kind whether mechanical, human, electronic or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors which may occur in connection with the administration of the Sweepstakes or the processing of entries; (iii) data corruption, theft, destruction, unauthorized access to or alteration of entry or other materials; (iv) any injuries, losses, costs, expenses or damages to person or property of any kind caused, in whole or in part, directly or indirectly, by the prize or resulting from redemption, acceptance, possession, loss or use or misuse of any prize or from participating in the Sweepstakes or any Sweepstakes related activity; or (v) any printing, typographical, administrative, human or technological errors in any material associated with the Sweepstakes. Limitations or exclusions of liability for incidental or consequential damages and/or exclusions of implied warranties subject to all applicable federal, state and local laws and regulations.

CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH ENTRANT OR ANY OTHER INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING CRIMINAL PROSECUTION.

Sponsor reserves the right, in its sole discretion, to modify, cancel or suspend this Sweepstakes (or any portion of the Sweepstakes) at any time and for any reason or no reason. Sponsor may prohibit an entrant from participating in the Sweepstakes or winning a prize if, in its sole discretion, of it determines entrant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, or other unfair practices or intending to annoy, abuse, threaten or harass any other participants or Sponsor’s representatives. The interpretation of these Official Rules shall be governed by the laws of the United States and the State of New York, without regard to its conflict of laws principles. Any disputes arising under, or related to, the Sweepstakes must be brought in the federal and state courts located in New York City, New York.

By entering the Sweepstakes, each entrant hereby agrees that Sponsor and any of their designees or subcontractors may use: (1) the personal information collected from entrant for the purpose of administering the Sweepstakes, fulfilling prizes (if applicable), and providing entrant with information relating to Sponsor or its affiliates and each of their, respective products, services and promotions and (2) his or her name, voice, biographical data and/or likeness in any and all media now known or hereinafter devised, throughout the universe and in perpetuity, for the purpose of advertising and promoting the Sweepstakes or any other promotion, contest or sweepstakes sponsored by Sponsor, except where prohibited by law. For example, each entrant understands and agrees that if he/she is selected as a potential winner, such entrant’s name, city and state may be announced at www.cheapoair.com and elsewhere.

Sponsor will not sell, share or otherwise disclose an entrant’s personal information to a third party, other than to those engaged by Sponsor to fulfill the above purposes, without the entrant’s permission.
